Duty of Care

The Duty of care states that you must take all reasonable steps to keep the waste you produce safe. As such, if you sub-contract someone else to dispose of your waste it is your responsibility as the producer to ensure they are authorised to transport, recycle or dispose of it legally and safely.
The Duty of Care applies to anyone produces or imports, keeps or stores, transports, treats or disposes of waste.
Please be aware that a breach of the Duty of Care is a criminal offence with a financial penalty on summary conviction or an unlimited fine on conviction on indictment.
Under the Duty of Care Regulations 1991, parties transferring waste are required to complete and retain a "transfer note", containing a written description of that waste. Defra has provided statutory guidance on the completion of the duty of care waste transfer note in: Waste Management, the Duty of Care: A Code of Practice.
